Terms & Conditions for Vivitstar™

This page (together with the documents referred to on it) outlines the Terms & Conditions (hereafter "Terms & Conditions") under which we supply any of the products (hereafter "Products") listed on our website www.vivitstar.com (the "Site") to you. The Products listed on the Site may be supplied directly by Vivitstar™.

Please read these Terms & Conditions carefully before placing an order for any Products from the Site. By placing an order for any of our Products, you agree to be bound by these Terms & Conditions. You can print a copy of these Terms & Conditions by selecting the print option in your browser's "File" menu. Please also note that the use of the Site is subject to the terms contained in the Website Terms of Use, which apply whether or not you place an order for any Products from the Site.

We take privacy seriously. The categories of personal data we process depend on how you use our services. We use your personal data to personalize our online and in-store services to meet your preferences, to process your purchases and provide customer services, to contact you regarding tailored products or services of interest, to administer prize draws or competitions, or for relevant administrative purposes. Information about us

The Site is operated by Vivitstar™ (hereafter "we," "us," or "our"). We are registered in the Netherlands under company number [insert company number] with our registered office at [insert address].

How the contract is formed between you and us

2.1 You may place an order to purchase a Product advertised for sale on the Site by following the onscreen prompts after selecting the item you are interested in. You will have an opportunity to review and correct any input errors in your order before submitting it by clicking the "Proceed to Secure Payment" button on the "Payment details" page. No amendments to your order can be made after you submit the order.

2.2 After placing an order, you will receive an email acknowledging that we have received your order, along with an order number and a summary of your order. Please note that this does not mean your order has been accepted. Your order is considered an offer to us to purchase a Product. All orders are subject to acceptance by us, and we will confirm such acceptance by sending you an email that confirms the dispatch of the Product (the "Dispatch Confirmation"). A contract between us for the sale of a Product is formed when we send you the Dispatch Confirmation for that Product. If you order multiple Products, each product will form a separate contract when we send the Dispatch Confirmation for each Product.

2.3 Each contract will relate only to the Products whose dispatch we confirm in the Dispatch Confirmation. We will not be obliged to supply any other Products from your order until the dispatch of those Products is confirmed.

2.4 We may choose not to accept your order for any reason and will not be liable to you or anyone else in such cases.

2.5 We may be unable to process your order if:

  • The Product is out of stock or discontinued; or
  • There is an issue with the authorization of your payment method.

2.6 Certain Products may be subject to age restrictions imposed by law. We are not permitted by law to supply these Products to individuals who do not meet the relevant age requirement. If you are underage, you must not attempt to order such Products. By registering on the Site, using the Site, and/or making a purchase, you confirm and certify that all information you provide, including but not limited to your date of birth, is accurate and up-to-date.

Delivery

3.1 We will deliver the Products to you according to the delivery option you select when placing your order.

3.2 We will dispatch all Products in your order at the same time, but sometimes, products may be shipped in multiple packages. Delivery will be made to the address you provide at the time of ordering. Please refer to our FAQ for details on our delivery options and restrictions. We cannot deliver items from the same order to multiple addresses. We are not responsible for any additional handling or positioning of the Products once delivered.

3.3 For certain bulky or heavy items, a delivery charge may apply, which will be added during the checkout process. Please ensure you are satisfied with the delivery charge before confirming your order.

Risk and Ownership

4.1 Once delivered, the Products become your responsibility. Except for Products that are damaged or faulty upon delivery or incorrectly delivered, we are not liable for their loss, damage, or destruction once they have been delivered.

4.2 Ownership of the Products transfers to you when:

  • The Products are delivered to you; or
  • We receive full payment for the Products, whichever occurs later.

Price and Payment

5.1 The price of the Products will be as stated on the Site, except in cases of obvious errors.

5.2 Prices include Dutch VAT at applicable rates but exclude delivery costs. If your delivery address is outside the Netherlands, taxes and import duties may be applied, and delivery costs will be added to the total at checkout.

5.3 Prices are subject to change, but such changes will not affect orders for which we have already issued a Dispatch Confirmation.

5.4 Payment can be made using major credit or debit cards through our secure payment process. Your payment must be completed before we process your order.

5.5 By using a credit/debit card, you confirm that the card being used is yours. All fields marked as compulsory must be completed. Your credit/debit card issuer may perform validation checks, and if they do not authorize payment, we will not accept your order and are not responsible for delays or non-delivery.

Our Cancellation, Returns, and Refund Policy

6.1 You may cancel your order at any time before dispatch and up to 28 days after receipt of the Products. To cancel your order, please contact us via email at info@vivitstar.com or use our contact page. If your order has already been dispatched, please follow our returns process.

6.2 Exceptions:

  • Perishable items, medicines, personalized products, sealed products, and products not suitable for return due to hygiene reasons cannot be canceled unless damaged or faulty upon delivery.

6.3 If you wish to cancel after dispatch, you will be required to return the Products at your own risk. We are not responsible for loss or damage during return shipping.

6.4 Products must be returned unused (except for reasonable examination) and in their original packaging.

6.5 Return Costs:

  • For Products dispatched directly by Vivitstar™, we will bear the return cost for items from the Netherlands or other countries within the EU. For other locations or large items, the return costs will be borne by you.

6.6 Refunds will be processed within 14 days of receiving the returned Products or proof of return. Refunds will be issued using the same payment method used for the purchase.

Our Liability

7.1 We are legally obliged to supply Products that are in conformity with the contract. We accept no liability for unforeseeable loss or business losses.

7.2 We do not exclude or limit our liability for death or personal injury caused by our negligence or fraud.

Any formal legal notices should be sent to our Customer Services address, which is available on the "Contact Us" section of the Site.

Events Outside Our Control

We will not be liable for failure to perform any of our obligations due to events outside of our reasonable control.

General

10.1 If any of these Terms & Conditions are deemed invalid or unenforceable, the remaining provisions will still apply.

10.2 We reserve the right to amend these Terms & Conditions without prior notice. Changes will be posted on the Site.

10.3 These Terms & Conditions are governed by Dutch law, and any disputes will be resolved by Dutch courts.

Registration

You must register and complete an online health questionnaire to use certain services. It is important that you provide accurate and complete information. By registering, you confirm that all information provided is true.

Age Restrictions

We accept orders only from individuals aged 16 or over. By placing an order for medicines, you confirm that you are aged 16 or over.
