Terms & Conditions

These terms apply to every order placed in the VIVITSTAR online store.

1. Company details

2. Applicability

These general terms and conditions apply to every offer made by VIVITSTAR and to every distance contract concluded between VIVITSTAR and a consumer through this online store. Before an order is placed, the text of these terms is made available electronically so that it can be stored and consulted later.

3. Offer and acceptance

Each offer contains a complete and accurate description of the products, including price and shipping information, sufficient for you to properly assess it. Obvious errors or mistakes in an offer are not binding on us. A contract is concluded at the moment you accept the offer by completing the ordering process and we confirm your order by email. As long as receipt of your order has not been confirmed, you may dissolve the contract.

4. Prices

All prices are stated in euros and include Dutch VAT. Shipping costs, where applicable, are shown separately before you complete your order. Prices are not increased during the validity period of an offer, except for changes resulting from statutory regulations such as VAT rates.

5. Payment

Payment is made at the time of ordering via one of the offered payment methods: iDEAL, credit card (Visa/Mastercard), PayPal, Klarna, Apple Pay or Google Pay. Payments are processed securely by our payment providers over an encrypted connection.

6. Delivery

We take the greatest possible care when receiving and executing orders. Orders placed on business days before 4:00 PM are dispatched the same day. Indicative delivery times are 1–2 business days within the Netherlands and 2–4 business days for Belgium and the rest of the EU. Delivery times are estimates and never a strict deadline; in any event we deliver within 30 days unless a different delivery period was agreed. If delivery within that period proves impossible, you will be informed and you have the right to dissolve the contract free of charge. See also our shipping policy.

7. Right of withdrawal

As a consumer you have the statutory right to withdraw from the contract within 14 days of receiving your order, without giving any reason. On top of this legal minimum, VIVITSTAR voluntarily offers an extended return window of 30 days from delivery. During this period, please handle the product and packaging with care.

To exercise your right of withdrawal, notify us within the period via hello@vivitstar.com (you may use the model withdrawal form in our returns & refund policy). You then have 14 days to return the product. Return shipping costs are at your own expense. After we receive the return, we refund the full purchase amount — including original standard shipping costs where the entire order is returned — within 14 days, using the same payment method you used.

8. Exceptions to the right of withdrawal

For reasons of health protection and hygiene, patches whose sealed packaging has been opened cannot be returned, unless the product is defective. Unopened packs in their original condition can always be returned within the return window.

9. Conformity, warranty and liability

We guarantee that our products comply with the contract, the specifications stated in the offer and the applicable statutory provisions. VIVITSTAR patches are wellness products designed to support a healthy lifestyle; they are not medicines and are not intended to diagnose, treat, cure or prevent any disease. They are not a substitute for a varied diet or professional medical advice. To the extent permitted by law, our liability is limited to the amount you paid for the order concerned. Nothing in these terms limits our liability for intent or gross negligence, or any liability that cannot be limited under Dutch law.

10. Complaints

Complaints about the execution of the contract should be submitted, fully and clearly described, within a reasonable time via hello@vivitstar.com. We respond within 14 days of receipt; if a complaint requires more time, we will let you know within that period when you can expect a substantive answer. If we cannot resolve your complaint together, you may submit the dispute to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

11. Applicable law

Contracts between VIVITSTAR and the consumer to which these terms apply are governed exclusively by Dutch law. This choice of law does not affect the protection you enjoy under mandatory provisions of the law of your country of residence.
